You know it, and you understand why companies want to collect what they are owed. That’s why you’re working to repay the debt as quickly and responsibly as possible. Still, harassment and constant reminders don’t help you earn more money or pay off your debt faster—if anything, they make the situation worse. The good news is that debt collectors have legal limits on how they can pursue payment. If they break the rules, there can be consequences.

Pay attention if you see a debt collector do any of the following:

#1 Show up at your workplace

It is illegal for a debt collector to appear in person at your workplace to collect a debt. Publicly disclosing your debt is prohibited, and showing up at your job to collect payment is considered a form of public disclosure.

#2 Call you at work after you asked them not to

While they cannot visit your workplace in person, they may attempt to call. To stop these calls, you must clearly request that they not contact you at work. They are required to stop. If they continue, they are violating the law.

#3 Call you at inconvenient times

There are also rules about when collectors can call. They cannot contact you before 8 a.m. or after 9 p.m. Additionally, you have the right to request that they stop calling you entirely. (Your obligation to pay the debt still exists even if they stop calling.)

#4 Harass you in any way

Harassment can include repeated phone calls, threats of violence, publishing information about you, or using abusive or obscene language. All of these actions are illegal under debt collection laws.

#5 Arrest you for debt

Unlike centuries ago, you cannot be arrested simply for owing money. That said, this does not mean there are no legal consequences. If a collector sues you and you fail to appear in court, you may lose the case by default and receive a court order to pay. If you then ignore that court order, they could request an arrest warrant for contempt of court. The best way to avoid this situation is to attend court hearings and comply with judicial rulings.

We hope this list gives you some peace of mind. Debt collectors must follow clear rules to operate within the law. If you notice they are not doing so, report them and seek the help you need.

This information is general in nature and does not constitute legal advice.
