You receive a call from an unknown number and someone on the other end tells you that you’re in serious trouble over an old debt. Someone with a spotless record might ignore it right away—but you’re not so sure. You do owe money. What if the call is real? You don’t want to overlook a legitimate problem or miss an important legal notice.

Handling debt collection matters can be complicated, especially when you’re unsure whether the person contacting you is legitimate or trying to scam you. How can you tell which calls are trustworthy and which ones are not? Here are some warning signs that the person on the phone may be attempting to scam you.

#1 They hide important information

A legitimate debt collector must provide you with:

The name of the creditor

The amount you owe

Notice that if you dispute the debt, they must obtain verification of it

If they don’t provide this information during the first contact, they must send you a written notice within five days.

#2 They threaten you with jail or claim to be authorities

Unlike centuries ago, you cannot be arrested and sent to jail simply for owing a debt. That said, there can still be legal consequences. If a collector sues you and you fail to appear in court, you may lose the case by default. If you then ignore the judge’s order and still fail to pay, they could pursue further legal action for contempt of court.

#3 You do not recognize the debt they claim

When you receive a call, ask questions to confirm that the debt actually belongs to you. By law, they must tell you who the creditor is and how much you owe. If you believe the debt is not yours, inform them that you will send a written request asking for more information. You also have the right to dispute the debt in writing.

Take Back Control

Are you receiving constant collection calls? Multiple calls a day from the same number? Are they filling up your voicemail or calling at all hours? You do not have to tolerate it—it could be illegal.

Knowing this is only the first step.
